By accessing and using Appeal Health's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Appeal Health provides AI-powered claim appeal services for diagnostic laboratories. Our platform helps labs:

  • Generate appeal letters for denied insurance claims
  • Analyze denial patterns and success rates
  • Streamline the appeals process
  • Provide consultation and support services

3. User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Use our services only for legitimate business purposes
  • Comply with all applicable laws and regulations
  • Not attempt to circumvent our security measures

4. HIPAA and Data Protection

Appeal Health is committed to HIPAA compliance and data protection. We will:

  • Implement appropriate safeguards for protected health information (PHI)
  • Only use PHI for authorized purposes
  • Maintain Business Associate Agreements (BAAs) with covered entities
  • Report any potential security incidents promptly

5. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or technical issues. We will provide reasonable notice when possible.

6. Intellectual Property

All content, features, and functionality of our services are owned by Appeal Health and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

7. Limitation of Liability

Appeal Health provides tools and services to assist with claim appeals but does not guarantee specific outcomes. We are not liable for:

  • Denied appeals or unsuccessful claim outcomes
  • Indirect, incidental, or consequential damages
  • Loss of revenue, profits, or business opportunities
  • Acts or omissions of third parties

8. Payment Terms

Payment terms will be specified in your service agreement. Generally:

  • Fees are due within 30 days of invoice
  • Late payments may incur additional charges
  • Services may be suspended for non-payment
  • Refunds are subject to our refund policy

9. Termination

Either party may terminate this agreement with 30 days written notice. We may terminate immediately if you breach these terms. Upon termination, you must cease using our services and return any confidential information.

10. Governing Law

These terms are governed by the laws of California, United States of America. Any disputes will be resolved through binding arbitration in San Diego, California.
